1. Definitions
In these Terms and Conditions:
- "We," "Us," "Our" refers to Cedar Flux, a senior care facility located in Phuket, Thailand
- "Services" refers to senior care programs including independent living, mobility support, and consultation services
- "Resident" refers to individuals receiving care services at Cedar Flux
- "Family" refers to relatives or designated representatives of residents
- "Agreement" refers to the service contract between Cedar Flux and the resident or their representative
- "Website" refers to our online presence at cedarfluxxas
2. Acceptance of Terms
By using our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
Residents must be 18 years of age or older, or have a legal guardian who can enter into this agreement on their behalf. By signing a service contract, you confirm that you have the legal capacity to enter into this agreement.
3. Service Description
Cedar Flux provides senior care services including:
- Independent Living with Support: Residential accommodation with housekeeping, meals, and assistance as needed
- Specialized Mobility Support: Adapted facilities and trained staff for residents requiring movement assistance
- Family Transition Consultation: Guidance services for families exploring care options
Services are subject to availability and may be modified based on resident needs and facility capacity. We reserve the right to adjust service offerings with appropriate notice to residents and families.
4. Enrollment and Admission
Admission to Cedar Flux requires completion of an application process, including health assessment and care needs evaluation. We reserve the right to decline admission if we determine we cannot adequately meet an applicant's care requirements.
Prior to admission, prospective residents and their families will receive:
- Detailed information about available services and pricing
- A written service agreement outlining terms of care
- Opportunity for facility tour and staff consultation
- Clear explanation of resident rights and responsibilities
5. Payment Terms
5.1 Fees and Charges
Monthly service fees are outlined in individual service agreements. All fees are quoted in Thai Baht (฿) and are subject to annual review and adjustment with 60 days advance notice.
5.2 Payment Schedule
Fees are payable monthly in advance. Payment methods include bank transfer, check, or credit card. Late payments may result in service suspension or termination.
5.3 Refund Policy
If a resident leaves Cedar Flux mid-month, fees will be calculated on a pro-rata basis. Advance payments for services not yet rendered will be refunded within 30 days. Consultation service fees are non-refundable once services have commenced.
6. Resident Rights and Responsibilities
6.1 Resident Rights
Residents have the right to:
- Be treated with dignity and respect
- Make decisions about their daily routines and care
- Privacy in their living spaces and medical information
- Receive visitors at reasonable hours
- Voice concerns and complaints without fear of reprisal
- Participate in care planning and reviews
6.2 Resident Responsibilities
Residents are responsible for:
- Treating staff and other residents with respect
- Following facility policies regarding safety and community living
- Providing accurate health information to care staff
- Timely payment of fees as outlined in service agreements
- Notifying staff of changes in health status or care needs
7. Care Services and Limitations
Cedar Flux provides residential care and support services but is not a hospital or medical facility. We coordinate with healthcare providers but do not provide medical treatment beyond basic first aid.
Services we do NOT provide include:
- 24-hour skilled nursing care
- Management of acute medical conditions requiring hospital-level intervention
- Specialized dementia care beyond basic support
- Mental health crisis intervention
If a resident's needs exceed our capabilities, we will work with families to arrange appropriate alternative care.
8. Modification of Services
We review resident care needs monthly and may recommend adjustments to service levels. Any changes to care plans or fees will be discussed with residents and families before implementation. Residents have the right to decline service changes, though this may affect their continued residency if we cannot safely meet their needs.
9. Termination
9.1 Termination by Resident
Residents may terminate services with 30 days written notice. Fees will be calculated on a pro-rata basis for the notice period.
9.2 Termination by Cedar Flux
We may terminate services under the following circumstances:
- Non-payment of fees for 30 days or more
- Resident care needs exceed our capabilities
- Behavior that threatens the safety or wellbeing of staff or other residents
- Material breach of service agreement terms
We will provide 30 days notice when possible and will work with families to arrange alternative care arrangements.
10. Limitation of Liability
Cedar Flux provides care services with reasonable skill and diligence but cannot guarantee specific health outcomes. We are not liable for:
- Health outcomes resulting from pre-existing conditions or natural progression of age-related decline
- Injuries sustained when residents decline recommended assistance
- Loss or damage to personal property unless caused by staff negligence
- Service interruptions due to circumstances beyond our control (natural disasters, civil unrest, etc.)
Our total liability for any claim arising from our services is limited to the amount of fees paid in the three months prior to the incident.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts in Phuket Province, Thailand.
12. Dispute Resolution
We encourage residents and families to raise concerns directly with our staff. For unresolved issues:
- Complaints should be submitted in writing to facility management
- We will acknowledge complaints within 3 business days
- Investigations will be completed within 30 days when possible
- Residents may request mediation for disputes before pursuing legal action
13. Website Use
Our website is provided for informational purposes. While we strive for accuracy, information on the website may not always reflect current services or availability. The website should not be relied upon as the sole source of information when making care decisions.
Users agree not to use the website for any unlawful purpose or in any way that could damage, disable, or impair the site.
14. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Cedar Flux or our licensors. Users may not reproduce, distribute, or create derivative works from our content without written permission.
15. Changes to Terms
We may update these Terms and Conditions periodically. Significant changes will be communicated to current residents and families via written notice. Continued use of our services following notice of changes constitutes acceptance of updated terms.
